Pink souvlaki! – Web design & social media management
1. Scope
These Terms & Conditions (T&C) apply to all services and contracts between Pink Souvlaki (hereinafter “we,” “us,” or “Pink Souvlaki”) and our clients (hereinafter “client” or “clients”).
Our services include, in particular, web design, web development, social media management, branding, content creation, and digital strategy.
By engaging our services, the client agrees to these Terms & Conditions as binding.
2. Conclusion of Contract
A contract between the client and Pink Souvlaki is formed once an offer has been confirmed in writing (e.g., by email) or once services have begun.
Unless otherwise stated, offers are valid for 30 days. Any changes or additions require written consent from both parties.
3. Services and Obligations
Pink Souvlaki undertakes to perform the agreed services professionally, carefully, and within the agreed timeline.
The client agrees to provide all necessary information, materials, and approvals required for the project in a timely manner. Delays caused by missing materials or late feedback may affect the project schedule.
4. Prices and Payment Terms
All prices are quoted in Swiss Francs (CHF), excluding VAT unless otherwise stated.
Invoices must be paid within 14 days of the invoice date without deductions.
In the event of late payment, we reserve the right to charge 5% annual interest and reminder fees.
For larger or ongoing projects, partial or milestone payments may be required. An advance payment of up to 50% of the project total may also be requested before work begins.
5. Copyright and Usage Rights
All designs, concepts, texts, graphics, photos, and strategies created by Pink Souvlaki are protected by copyright.
Usage rights are only transferred to the client after full payment has been received.
Without prior written consent, our work may not be modified, resold, or redistributed.
Pink Souvlaki reserves the right to use completed works for portfolio and reference purposes (e.g., website, social media, or presentations) unless the client explicitly objects.
6. Duration and Termination (for Ongoing Services)
For ongoing contracts such as social media management or maintenance services, the agreed minimum duration (usually 3 or 6 months) applies.
After this period, either party may terminate the contract with 30 days’ written notice to the end of the month.
All work performed up to the termination date will be invoiced in full.
7. Liability
Pink Souvlaki is liable only for intentional or grossly negligent actions.
Liability for indirect damages, lost profits, or data loss is expressly excluded.
The client is responsible for reviewing all materials, websites, and content prior to publication. Once approved, the client assumes full responsibility for all published material.
8. Data Protection
Pink Souvlaki handles all client information confidentially and in accordance with our Privacy Policy and applicable data protection laws.
Personal data will only be shared with third parties when necessary to fulfill the contract (e.g., hosting providers, domain registration, or social media tools).
9. Changes to Services and Delays
Any changes to the agreed scope of services must be documented in writing and may result in additional costs or extended delivery times.
We are not liable for project delays caused by the client, such as missing content, delayed approvals, or incomplete feedback.
10. Warranty and Support
After project completion, Pink Souvlaki offers a 14-day correction period for minor technical adjustments or fixes.
Any support or maintenance beyond this period must be agreed upon separately (e.g., through a maintenance or monthly service contract).
11. Governing Law and Jurisdiction
These Terms & Conditions are governed by Swiss law.
The place of jurisdiction is Bern, Switzerland, subject to any mandatory legal provisions to the contrary.
12. Amendments to the Terms & Conditions
Pink Souvlaki reserves the right to amend these Terms & Conditions at any time.
The latest version is published on our website and applies from the date of publication.
